Riverside Drug Crime Lawyer

Possession, Trafficking, Distribution, Manufacturing, Cultivation

Drug offenses are not taken lightly on a federal or a state level. When evaluating a drug offense, a court of law will decide on the severity of a sentence based on the type of crime, the type of drug possessed and the amount of drug found. The conviction of a drug offense is enough to affect your personal and professional life for a long stretch of your life, so it is critical that you get in touch with a Riverside criminal defense attorney to properly evaluate your situation.

Most drug offenses involve possession, distribution, trafficking, possession for sale, cultivation and manufacturing. Federal law prohibits substances such as marijuana, cocaine, methamphetamine (meth), heroin, ecstasy (and other party drugs), and unauthorized prescription medications for abusive or recreational purposes, like Oxycontin. The Drug Abuse Prevention and Control Act of 1970 strictly regulates drug crimes by means of a uniform system, dividing the severity of drug crime levels into five different "Schedules":

  • Schedule I: A high potential for abuse with no medicinal benefits, such as heroin, mescaline, peyote, LSD and marijuana.
  • Schedule II: Although currently accepted for medical use, drugs with a high potential for abuse and severe psychological or physical dependency, such as cocaine, opium, amphetamines, methadone, and methamphetamines.
  • Schedule III: Moderate potential lower than that of Schedule II substances, such as naline.
  • Schedule IV: Limited potential for dependency and accepted for medicinal use, such as meprobamate, chloral hydrate, tranquilizers, sedatives, and sleeping aids.
  • Schedule V: Low potential for abuse, accepted for medicinal use and low risk for dependency, such as limited use of codeine and other narcotics.

Potential sentences for drug offenses include fines, court ordered rehabilitation, community service, probation and imprisonment, as well as forfeiture of your personal assets and property, such as homes, cars or other assets in some larger cases.
